These Terms of Use (the "Terms") govern your access to and use of www.blueskyinnovations.com and the related BlueSky websites that link to these Terms (together, the "Site"). The Site is operated by BlueSky Innovations Holdings, Inc. and its subsidiaries, including BlueSky Mast, BlueSky Mobile Power and BlueSky Robotics (together, "BlueSky", "we", "us" or "our"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. Use of the Site

The Site provides information about BlueSky's products and services. You may use the Site for lawful purposes only. You agree not to interfere with the Site's operation, attempt to gain unauthorized access to any part of the Site or its systems, scrape or harvest content or contact data in bulk, or use the Site in any way that violates applicable law.

2. Product information

Specifications, performance figures, images, drawings and other product information on the Site are provided for general information. They may be updated, corrected or withdrawn at any time without notice. Product configurations, availability and specifications are confirmed only in a written quotation or contract issued by BlueSky. Nothing on the Site is an offer to sell. BlueSky's sales are governed by its written Terms and Conditions of Purchase and any applicable contract, not by these Terms.

3. Export controls

BlueSky products may be subject to United States export control laws and regulations, including the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR). The Site contains publicly releasable information only. You are responsible for complying with all applicable export, re-export and import laws in connection with any product or technical data you obtain from BlueSky.

4. Intellectual property

The Site and its content, including text, graphics, photographs, logos, product names, designs, drawings, data and software, are owned by or licensed to BlueSky and are protected by United States and international copyright, trademark and other intellectual property laws. BlueSky, BlueSky Mast, BlueSky Mobile Power, BlueSky Robotics and the related logos are trademarks of BlueSky. Third-party product names and logos appearing on the Site belong to their respective owners and are used to identify compatible payloads and partner equipment. You may view and print Site content for your own informational use. Any other use, including reproduction, modification, distribution or republication, requires BlueSky's prior written permission.

5. Submissions

Information you submit through forms on the Site is handled as described in our Privacy Policy. Do not submit classified information, Controlled Unclassified Information (CUI), export-controlled technical data or other sensitive information through the Site. Use the contact details provided by your BlueSky representative for such communications.

6. Third-party links

The Site may link to third-party websites, including partner and payload manufacturer sites. BlueSky does not control and is not responsible for the content, policies or practices of third-party sites. Links are provided for convenience only.

7. Disclaimer of warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. BlueSky does not warrant that the Site will be uninterrupted, error-free or free of harmful components. Product warranties, if any, are set out in BlueSky's written sales terms.

8. Limitation of liability

To the fullest extent permitted by law, BlueSky and its officers, directors, employees and agents will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of data, revenue or profits, arising out of or related to your use of or inability to use the Site, even if advised of the possibility of such damages. BlueSky's total liability for any claim arising from the Site will not exceed one hundred U.S. dollars (US$100).

9. Indemnity

You agree to indemnify and hold BlueSky harmless from any claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Site.

10. Governing law

These Terms are governed by the laws of the State of Florida and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute arising from the Site or these Terms will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to their jurisdiction.

11. Changes

BlueSky may revise these Terms at any time by posting an updated version on the Site. The "Last updated" date above shows when the Terms last changed. Your continued use of the Site after a change means you accept the revised Terms.
